1. Acceptance and eligibility

By using the Site, you confirm that you are at least 16 years old and that you can form a binding agreement. If you are under 18, you may use the Site only with the involvement and supervision of a parent or legal guardian who agrees to these Terms. If you are using the Site on behalf of an employer or another entity, you represent that you have authority to bind that entity to these Terms.

The Site provides educational content and training about seasonal outerwear product expertise and customer consulting. The training discusses outerwear categories (such as jackets, coats, parkas, insulated layers, and shells), product features, and communication methods used in clothing retail environments.

3. Service description; changes to the Site

We are not obligated to provide any specific feature for any particular duration.

6. Intellectual property

The Site and its content (including text, course structure, module descriptions, visual design, and any downloadable or viewable training materials) are owned by Cofrvianx Learning s.r.o. or licensed to us, and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal or internal business training purposes. You may not copy, reproduce, republish, distribute, or create derivative works from the Site content except as permitted by mandatory law or with our prior written permission.

7. Third-party services and links

The Site may contain links to third-party websites (for example, policy references or map links). We do not control those third parties and are not responsible for their content, availability, security practices, or policies. Your use of third-party services is governed by their own terms and privacy policies.

8. Disclaimer of warranties

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim all warranties and representations, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted availability.

9. Limitation of liability

To the maximum extent permitted by applicable law, Cofrvianx Learning s.r.o. will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of (or inability to use) the Site.

To the extent liability cannot be excluded, our total liability for all claims in any 12-month period will be limited to the greater of (a) the amount you paid to us in that period for access to the Site or related training, or (b) EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, such as liability for intentional misconduct, or for death or personal injury caused by negligence where such limitation is prohibited.

10. Indemnification

You agree to indemnify and hold harmless Cofrvianx Learning s.r.o., its officers, directors, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your misuse of the Site; (b) information you submit through the Site; or (c) your violation of these Terms or applicable law.

11. Force majeure

We are not responsible for any delay or failure to perform resulting from events beyond our reasonable control, including natural disasters, acts of government, war, terrorism, labor disputes, internet outages, cloud provider failures, cyberattacks, or power disruptions.

12. International use

The Site is operated from Czechia. We make no representation that the Site is appropriate or legally available in every jurisdiction. You are responsible for complying with local laws and regulations that apply to your access and use of the Site.

13. Governing law and dispute resolution

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law rules. The courts of Prague, Czech Republic will have jurisdiction over disputes arising from or relating to these Terms or the Site, except where mandatory consumer protection rules require otherwise.

14. Termination

We may suspend or terminate access to the Site at any time if we reasonably believe you have violated these Terms or if your use creates risk to the Site, other users, or our operations. You may stop using the Site at any time.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

15. General provisions

Severability: If any part of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.

Entire agreement: These Terms, together with the Privacy Policy and Cookie Policy, form the entire agreement between you and Cofrvianx Learning s.r.o. regarding the Site.

Assignment: We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign these Terms without our prior written consent.

No waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.

Modifications: We may update these Terms from time to time. Updated Terms become effective 14 days after posting on this page, unless the change is required by law or is administrative in nature, in which case it may take effect immediately. Your continued use of the Site after the effective date means you accept the updated Terms.

Electronic communications: You agree that communications and agreements may be provided electronically and that such communications satisfy legal requirements for written form where applicable.
